Family Lawyers in The UK

There are many issues that involve legislations concerning family in the UK. If you are currently facing a legal dispute that may involve these laws, then you should not waste time and get legal advice from a family lawyer as soon as possible. A family lawyer is always expected to possess a wide area of knowledge and expertise in all fields covered by UK’s family laws. This is necessary in order for your lawyer to be able to recognize when to enter into negotiations and when it might be worth taking the other party’s unrealistic demands into the UK Family Court.

Talk To Your Family Lawyer in the UK

Are you facing an issue involving divorce? Is there child custody involved? Is it a simple matter of divorcing after having not spent any time with each other for the past few years? The circumstances of your case could affect its eventual outcome, which is why it is very important for you to talk to your lawyer about your particular issue. This helps the family lawyer to decide on what is the best course of action for you. Your lawyer will apprise you of the legal fees involved in a divorce proceeding or other similar family law issues and if there are any complications that may be expected to arise. What is more important is that you also have a clear understanding of what you want to happen so that the solicitor can duly inform you of what can be realistically done in order to make your ideal scenario a reality.

No Fault Divorce Doesn’t Exist In The UK

It is worth noting at this point that divorce is only one of the many areas of UK family law, but it is also one of the most active areas, which is why it is definitely worth discussing. While divorce laws exist in England and Wales, you should know that “no fault divorce” like in the US is not allowed under UK law. A two-year period of separation is the general requirement before a divorce can be entered into. This prevents couples who may wish to just terminate the marriage because it does not work out, without many options for getting a divorce. The quickest way to get divorced in the UK is to use the grounds of either unreasonable behaviour, or even worse, adultery, in order to secure the divorce. In other words, both of the quicker options require you (or your partner) to play the bad guy. There are of course workarounds to this for couples who are not actually on bad terms with each other. In practice, the allegations used for unreasonable behavior are mild enough to be considered irrelevant by most people, but serious enough for the courts to take cognizance of the case and allow a divorce.

The Property Regime

The property regime that takes place during the marriage between two people is generally dictated by law. However, if there are any pre-nuptial or post-nuptial agreements in place, then these are more controlling and to be followed. A family lawyer can assist in this area by ensuring that the provisions of the agreement are followed meticulously and that none of them are contrary to law.
